These Terms of Service ("Terms") govern your use of byrowan.co (the "Site") and your purchase of products from Rowan Foods LLC, a New Jersey limited liability company doing business as "By Rowan" ("we", "our", "us"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years of age to place an order. By placing an order, you represent that you are 18 or older and that the information you provide is accurate and complete.

2. Products

VIOLET is a hot sauce intended for use as a culinary condiment. We make every effort to display product descriptions, ingredients, and photographs accurately, but we do not warrant that descriptions or other content on the Site are error-free. Bottle artwork, label revisions, and minor batch-to-batch variations are normal for small-batch food products.

3. Allergens and food safety

Read the ingredient list and allergen statement on the bottle before consuming. By Rowan products are produced in a facility that handles common food allergens. If you have a known food allergy, sensitivity, or medical condition, consult a physician before consuming. We are not liable for adverse reactions to ingredients disclosed on the label.

4. Orders and pricing

All prices are listed in U.S. dollars. We reserve the right to change prices, modify or discontinue products, and limit order quantities at any time without prior notice. Acceptance of your order is not complete until we send a shipping confirmation. We may cancel any order before shipment for any reason, in which case we will refund the original payment in full.

5. Payment

We accept the payment methods listed at checkout. By submitting payment information, you authorize us (and our payment processor) to charge the total order amount, including applicable taxes and shipping.

6. Shipping and returns

Shipping terms are governed by our Shipping Policy. Returns and refunds are governed by our Return and Refund Policy. Both are incorporated into these Terms by reference.

7. Marketing communications

By providing your email or mobile number, you may opt in to receive marketing communications from us. You can unsubscribe from email at any time by clicking "unsubscribe" in any email, and from SMS by replying STOP. Message and data rates may apply. SMS marketing is governed by our Privacy Policy and applicable law (TCPA).

8. Intellectual property

All content on the Site - including the "BY ROWAN" wordmark, "VIOLET" name, logos, photography, copy, and code - is owned by Rowan Foods LLC or licensed to us, and is protected by U.S. and international copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.

9. User conduct

You agree not to (a) use the Site for any unlawful purpose, (b) attempt to gain unauthorized access to any portion of the Site, (c) interfere with or disrupt the Site or its underlying servers, or (d) scrape, mirror, or otherwise reproduce the Site at scale.

10. Disclaimer of warranties

The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms, the Site, or the products is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to indemnify and hold harmless Rowan Foods LLC, its officers, employees, and contractors from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site or products.

13. Governing law

These Terms are governed by and construed under the laws of the State of New Jersey, without regard to conflict-of-laws principles. The parties agree that any dispute that is not subject to arbitration under Section 14 will be brought exclusively in the state or federal courts located in Somerset County, New Jersey, and you consent to the personal jurisdiction of those courts.

14. Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the products, or our marketing communications - including questions about validity, enforceability, or scope of this arbitration clause - will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, then in effect. The arbitration will be held in Somerset County, New Jersey, or by video, at the consumer's election. Judgment on the award may be entered in any court of competent jurisdiction.

You and we each agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to rowan.moynihan@rowdaddi.com within 30 days of first agreeing to these Terms. The notice must include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration.

Notwithstanding the above, either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
